I’m frequently asked about my work as an audiology expert witness. To understand fully it’s good to take a step back and look at the history of experts in legal disputes. The use of forensic experts in legal matters has an ancient heritage. In Babylonia, experts were used to determine pregnancy, virginity and fertility.  The Romans legally recognized experts in midwifery, handwriting, and land surveying. In the past 250 years, the use of expert witnesses and the admissibility of their testimony and scientific evidence has developed significantly in the Western court system.

In our system, an expert witness is a person whose opinion by virtue of education, training, certification, skills or experience, is accepted by a judge as an expert. The judge may consider the witness’s specialized scientific, technical or other opinion about the evidence and/or facts before the court within the expert’s area of expertise. This is referred to as an “expert opinion”. Expert witnesses may also deliver “expert evidence”, but only within their area of their expertise and their testimony may be rebutted by the testimony of other experts or by other evidence or facts.

Expert witnesses are an important part of the American system of justice. The role of the expert witness is to help the judge and jury understand the evidence in the case under consideration. An expert witness is basically a teacher, distilling complex issues into understandable testimony.
